Sasa Mall by Mayson Africa Limited – Terms and Conditions

Welcome to Sasa Mall, your premier e-commerce marketplace operated by Mayson Africa Limited. These Terms and Conditions ("Terms") govern your use of the Sasa Mall website, mobile application, and any other online platforms (collectively referred to as the "Platform"). By accessing or using the Platform, you agree to comply with and be bound by these Terms. Please read them carefully before engaging in any online buying or selling activities.


1. Acceptance of Terms

By accessing or using Sasa Mall, you acknowledge and agree that you have read, understood, and accepted these eCommerce platform terms. If you do not agree with any part of these Terms, you must not access or use the Platform for online transactions.


2. User Registration

To access certain features of the Platform, you must register an account. You can register as a Buyer, Seller, or Deliveryman on the online marketplace. By registering, you agree to provide accurate, current, and complete information during the sign-up process and to keep your account details updated. You are responsible for the confidentiality of your account information and for all activities that occur under your account.


3. Roles and Responsibilities

A. Buyers:

  • Buyers are individuals or businesses who make purchases on the e-commerce platform.
  • Buyers must review product listings (including price, description, and shipping details) before completing a purchase.
  • Buyers are responsible for completing the payment for the products purchased, including any shipping fees, and providing accurate shipping information.
  • For any issues related to returns, exchanges, or refunds, Buyers must contact Sasa Mall in accordance with our e-commerce policies.

B. Sellers:

  • Sellers are businesses or individuals who list and sell products on the Platform.
  • Sellers are responsible for providing accurate product descriptions, including pricing, quantity, and product details.
  • Sellers must ensure timely shipping and handling of orders as well as process returns, refunds, or exchanges according to the e-commerce platform's return policies.
  • Sellers are also responsible for ensuring that their products comply with relevant laws and regulations.

C. Deliverymen:

  • Deliverymen are responsible for transporting purchased goods from Sellers to Buyers.
  • Deliverymen must ensure timely delivery and safe handling of products throughout the shipping process.
  • Deliverymen must follow the instructions provided by the Sellers and Buyers for the safe and accurate delivery of orders.

4. Platform Use

By using the Platform, you agree to use it only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

  • Violate any applicable laws, rules, or regulations.
  • Engage in fraudulent or illegal activities related to buying or selling products.
  • Upload or distribute viruses, malware, or other harmful content that may disrupt the Platform or users' experience.
  • Infringe on intellectual property rights related to online product listings or other Platform content.
  • Disrupt the functionality of the e-commerce platform or interfere with other users' experiences.

5. Transactions and Payments

Sasa Mall offers a secure payment processing system to facilitate transactions between Buyers, Sellers, and Deliverymen. Payments for products and services should be made using the available payment methods on the Platform.

  • Buyers agree to pay for purchased items, including shipping costs, as part of their transaction on the Platform.
  • Sellers must ensure that goods are available for dispatch and will confirm shipment of the items once the order has been processed.
  • Deliverymen will be paid for the delivery services they provide in accordance with the terms agreed with Sasa Mall. The payment terms for Deliverymen are defined by the specific agreement between Sasa Mall and the Deliveryman.

Sasa Mall is not responsible for payment disputes between Buyers and Sellers.


6. Pricing and Availability

Prices for products on the Platform are subject to change without notice. While we aim for accuracy, pricing errors or inventory issues may occur. In such cases, we will notify the Buyer before processing the order.

Sasa Mall reserves the right to cancel or modify any orders based on pricing errors or product availability.


7. Shipping and Delivery

Sasa Mall provides an online marketplace where Buyers and Sellers interact, but Deliverymen are responsible for the shipping and delivery of goods purchased.

  • Buyers should ensure accurate shipping information is provided to avoid delivery issues.
  • Sellers must provide correct packaging and ensure products are shipped within the agreed-upon time frame.
  • Deliverymen must ensure products are delivered safely and on time to the Buyer's address.

Shipping costs and times vary based on the Seller's location, Buyer's location, and the delivery method chosen.


8. Returns, Refunds, and Exchanges

Sasa Mall offers support for returns, refunds, and exchanges through a standard process to ensure a smooth e-commerce transaction experience.

  • Buyers must contact Sasa Mall for any issues related to returns, refunds, or exchanges as per the e-commerce policies outlined on the Platform.
  • Sellers must follow the Platform's policies for processing return requests and cooperating with Sasa Mall to resolve issues.
  • Deliverymen are not responsible for handling returns, refunds, or exchanges, but must ensure products are delivered as agreed.

9. Intellectual Property Rights

All trademarks, logos, and product listings on the Platform are owned by their respective owners or licensed to Mayson Africa Limited. These materials are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, or distribute any of this intellectual property without the explicit written permission of the rightful owner.


10. Privacy Policy

By using Sasa Mall, you agree to our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review our Privacy Policy to understand how your personal data is handled when you make online purchases or register as a Seller or Deliveryman.


11. Limitation of Liability

To the maximum extent permitted by law, Mayson Africa Limited is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including loss of profits, business interruptions, or damages resulting from the conduct of Buyers, Sellers, or Deliverymen. Our liability will be limited to the amount paid for the goods or services involved in the dispute.


12. Indemnity

You agree to indemnify and hold harmless Mayson Africa Limited, its affiliates, employees, and partners from any claims, losses, or liabilities that arise out of your use of the Platform, including violations of these Terms and Conditions.


13. Termination

Mayson Africa Limited reserves the right to suspend or terminate your access to the Platform at any time, for any reason, including if we believe you have violated these Terms. Upon termination, you must immediately cease using the Platform.


14. Dispute Resolution

In case of a dispute between Buyers, Sellers, Deliverymen, or Mayson Africa Limited, we encourage direct communication to resolve the issue amicably. If a resolution cannot be reached, disputes will be resolved through binding arbitration, according to the laws of Tanzania.


15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on the Platform and will become effective immediately. We encourage you to review the Terms periodically.


16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Tanzania. Any legal action or proceeding under these Terms shall be subject to the exclusive jurisdiction of the courts in Tanzania.
